These Terms of Service ("Terms") govern your use of ChoppyMoo.com (the "Site") and all products, services, and educational software provided by HappyTrout, LLC ("we," "us," or "our"). By accessing or using our Site, you agree to be bound by these Terms.

• Personal, non-commercial use
• Educational use in classroom settings with proper attribution
• Content you have purchased and downloaded for permitted use

6. Product Purchases and Orders

When you place an order through our Site, you are making an offer to purchase products. We reserve the right to accept or decline your order for any reason, including product availability, errors in pricing or product information, or suspected fraud.

All orders are subject to acceptance and availability. We will send you an email confirmation when your order is accepted. This confirmation constitutes our acceptance of your order and forms a binding contract.

Payment must be made at the time of purchase using one of our accepted payment methods. We use secure third-party payment processors (Stripe) to handle all payment transactions. We do not store your complete payment card information on our servers.

Applicable taxes and shipping fees will be calculated and displayed during checkout.

8. Shipping and Delivery

We ship to addresses within the United States. Shipping times and costs vary based on your location and selected shipping method. Estimated delivery dates are provided during checkout but are not guaranteed.

Risk of loss and title for physical products pass to you upon delivery to the carrier. We are not responsible for delays caused by shipping carriers, weather, or other circumstances beyond our control.

For digital products and software, access will be provided immediately upon purchase confirmation via email or account dashboard.

9. Returns and Refunds

Physical Products: You may return unopened, unused products in their original packaging within 30 days of delivery for a full refund. Return shipping costs are the responsibility of the customer unless the return is due to our error or a defective product.

Digital Products and Software: Due to the nature of digital products, all sales are final once access has been granted. Refunds may be issued at our discretion if there is a technical issue preventing access that we cannot resolve.

10. Educational Content and Software

Our educational software and content are provided "as is" for educational purposes. While we strive to ensure accuracy and quality, we make no guarantees about specific educational outcomes or results.

• Any bugs, viruses, or similar issues transmitted by third parties
• Any errors or omissions in content or loss of content or data

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or the Site shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

You agree to waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.
